Affiliate Terms & Conditions

Definitions:
We/Our/ The business implies; herbalist.net.au, Tamaras Herbal & Natural Therapies or the individual owners & partners.
The Affiliate implies; 	Person authorized to promote herbalist.net.au

At herbalist.net.au we have this affiliate program which rewards individuals and businesses who introduce our web site their friends and customers. In return for promoting our business we will pay you a generous commission on every sale that is made by someone you have sent to our business, in addition if anyone you refer refers someone you will also make a commission, so your efforts can compound.

We don’t promise to make you rich, but you can make a very good second income for very little effort. We will help as much as we can; it is in our interest to do so.

Commissions Structure:
Tier 1-	5%
Tier 2- 2%
Tier 3- 0 

In addition all affiliates qualify for 10% discount on in clinic services. See home page for more details.

The affiliate undertakes to promote herbalist.net.au in a positive & ethical manner. 

Commissions will be paid monthly.
Payments made by cheque will incur a $ 10.00 administration fee.
Otherwise payments can be direct deposited into your bank account or a Paypal account, with only bank or Paypal fees to apply.

Accounts must reach a balance of $ 15.00 before payments will be made. 
We reserve the right to change commission structure without notice.

We reserve the right to cancel anyone’s affiliate status at anytime without notice or explanation.

We will not be held liable for any errors in payment processing.
Over payment of commissions must be notified to us, with overpayments to be returned or debited from following months commissions.
Payment of commission on products that are returned or refunded will incur a reversal of commission.
 
The extent of the affiliates role is to refer the herbalist.net.au website and the concept of buying online from herbalist.net.au and in return for purchases made online, as a result of the referrals, a commission will be paid. 

We will in no way accept responsibility or liability for any false or misleading claims made by an affiliate, and will hold said affiliate liable/responsible.

The affiliate has no managerial or financial role within the business and as such has no authority to enter into any agreement on our behalf. In addition: 

The affiliate is not authorized to offer any advice on the use of any products or suggest any method of treatment for any type of health condition and if they do, it is completely unauthorized and as such we accept no responsibility for any action legal or otherwise that may arise as a result of any unauthorized advice.

The affiliate is not authorized to offer discounts unless part of a promotion being run by the business. 

The affiliate or any former affiliate is not to do anything that can cause harm to the business.
The affiliate shall indemnify us from any and all legal actions, damages or liabilities incurred from the day-to-day operations of the affiliate. We will own all right, title and interest in and to all information that is created or collected in the operation of the herbalist.net.au (Tamara’s Herbal & Natural Therapies) site and reserves the right to amend or terminate this Agreement at any time, with or without notice to the affiliate. 
It is the full responsibility of the affiliate to market  herbalist.net.au (Tamara’s Herbal & Natural Therapies) in a legal, ethical and honest fashion and the affiliate agrees that herbalist.net.au (Tamara’s Herbal & Natural Therapies) will be held harmless from any and all actions of the affiliate and the affiliates marketing and promotional programs. The affiliate shall at all times comply with all local and Federal spam, fax broadcast and telemarketing laws. Any affiliate advertisement that does not comply with applicable local, state or federal laws is strictly forbidden and shall be expressly defined as unauthorized use of herbalist.net.au (Tamara’s Herbal & Natural Therapies), marks and names. Should action be brought against herbalist.net.au (Tamara’s Herbal & Natural Therapies) and owners for such activity by the affiliate, the affiliate agrees to bear all costs and penalties associated with such activity including, but not limited to herbalist.net.au (Tamara’s Herbal & Natural Therapies) and owners legal costs for any alleged infraction of these laws. herbalist.net.au (Tamara’s Herbal & Natural Therapies) reserves the right to amend all pricing plans, commissions or conditions relative to this agreement. herbalist.net.au (Tamaras Herbal & Natural Therapies) & owners reserves the right to terminate any affiliate with or without cause at the sole discretion of herbalist.net.au (Tamaras Herbal & Natural Therapies) & owners with or without notice. By joining the herbalist.net.au (Tamara’s Herbal & Natural Therapies) affiliate program, affiliate is tendering his/her personal guarantee of these terms and conditions. 
The affiliate shall not issue nor cause to be issued any news/media/press release that uses the herbalist.net.au (Tamara’s Herbal & Natural Therapies) trademarks(s) without prior written consent from herbalist.net.au (Tamara’s Herbal & Natural Therapies) and Owners. 
This Agreement shall be governed by the laws of the State of NSW, Australia. Should there be any legal dispute between the parties, arbitration/mediation will be at a location of herbalist.net.au (Tamara’s Herbal & Natural Therapies) and Owners discretion should we request arbitration/mediation in lieu of or prior to formal legal process.
Enrolment in the herbalist.net.au affiliate program is seen as the affiliates acceptance of the above terms & conditions.
